Debt Collection Process

The first step in collecting a debt is to obtain a judgment against the debtor. Once a judgment is docketed in District Court the judgment becomes a lien on all real property the debtor owns in the county where docketed. Regardless of whether there is a judgment docketed or not, the first thing we do is contact the debtor to see if the situation can be easily remedied without going to court or using legal remedies to take the money or property owed.

If the debtor does not want to cooperate, which is normally the case, there are different collection options depending on the circumstances of the parties. If we are dealing with a secure debt, we may be looking at a repossession, Uniform Commercial Code (UCC) asset recovery, or foreclosure depending on what type of property we are dealing with. If the debt is unsecured, we often look to garnish the debtor's wages, levy on property, or levy on bank accounts.
